Procurement law is the most dynamic of all fields of law. It is characterised by frequent changes in legislation both at national and European level. Moreover, decisions by the European Court of Justice and the national procurement review authority have lead to the steady development of procurement law.

Horst Fössl specialises in procurement law and other public procurement related issues. In large procurement projects resources are pooled and a team of specialists is assembled.

Horst Fössl has been advising on procurement law and other public procurement related issues for many years. His expertise in construction law and the law of construction contracts (which are of paramount importance in large construction and infrastructure projects), rounds off the range of consulting services that we offer in this area.

Questions regarding procurement law very often arise in privatisations and spin-offs, as well as so-called public private partnerships and public finance initiatives (PPP and PFI).

Singer Fössl will advise you and offer know-how, while finding customised solutions for you that do not put pressure on you for the duration of the contract.

We offer principals as well as tenderers comprehensive or step-by-step advice on procurement law during procurement projects. (Please also see: Services and methods).

Our services on the principal-side begin in the planning phase – preparing expert assessments and feasability studies. In the implementation phase the array of services we offer ranges from the public notice of award procedures and the preparation of tender documents to drafting the contract and award of the contract.

We support tenderers by examining tender documents, and by doing so we will help you to accurately assess your risk. We will advise you in order to prevent flaws in the offer before and during the tender. Of course we will also support you in negotiations and setting-up a contract.

In review procedures, we represent the principal and tenderer before all Austrian procurement supervisory authorities, such as the Federal Procurement Authority, the independent administrative review panels in the Austrian federal states and the public law courts (the Higher Administrative Court, Constitutional Court). We will also secure your rights in European Commission proceedings and before the European Court of Justice. Damage compensation and competition proceedings in the civil courts complete our services in this area.

We are at your disposal should you require further information or an analysis of your situation.
