Data Protection Statement/Information pursuant to Art 13 GDPR of Singer Fössl Rechtsanwälte OG

1. Personal Data / Legal Basis of Data Processing

We, Singer Fössl Rechtsanwälte OG, collect, process and use your personal data for the following purposes only:

  • for the initiation or performance of contractual relations/mandates (Art 6 para 1 lit b GDPR) or
  • on the basis of your consent (Art 6 para 1 lit a GDPR) or
  • on a different legal basis as may exist under the GDPR (including, without being limited to, a legal obligation pursuant to Art 6 (1) (c) GDPR or a legitimate interest pursuant to Art 6 (1) (f) GDPR).

Your data will always be processed in compliance with provisions of data protection legislation and civil law.

We will only collect such personal data as is necessary for the performance and handling of our services as attorneys or such as you have made available to us voluntarily.

Personal data are defined as any and all data which contain individual details about personal or factual circumstances, such as name, address, e-mail address, telephone number, date of birth, age, gender, social security number, video recordings, photos, voice recordings of persons and biometric data such as fingerprints. Sensitive data, such as health data or data relating to criminal proceedings, may also be included in individual cases, but are not processed systematically

2. Right to Information and Erasure

As a client or, more generally, as a data subject, and subject to client-attorney privilege, you have the right to information about your personal data stored, their origin and recipients as well as the purpose of data processing and the right to correction, data transmission, objection, restriction of processing, blocking or erasure of incorrect or impermissibly processed data at any time.

In the event of changes in your personal data, we would appreciate to be informed accordingly.

You have the right to revoke any consent you have given to the use of your personal data at any time. Please send your request for information, erasure, correction, objection and/or (provided that no disproportionate effort is caused) data transmission to the address of the law firm stated in Clause 10. of this Statement.

If you believe that applicable data protection law has been breached by our processing of your personal data or that your entitlements under data protection law have been infringed in any other way, you may object by filing a complaint with the competent regulatory authority. In Austria, the Data Protection Authority is the regulator in charge.

3. Data Security

Your personal data are protected by appropriate organizational and technical measures. These include, without being limited to, protection against unauthorized, illegal or accidental access, processing, loss, use and manipulation.

Notwithstanding our efforts to maintain a consistently high level of due diligence, we cannot exclude the possibility that information you provide to us via the Internet may be viewed and used by others.

Please note that, for this reason, we do not assume any liability whatsoever for the disclosure of information due to errors in data transmission and/or unauthorized access by third parties which we have not caused (e.g. hacking of email accounts or telephone, interception of faxes).

4. Use of Data / Purpose of Data Processing

We will not process data provided to us for purposes other than those covered by your mandate agreement or by your consent, or otherwise by a provision of the GDPR. This does not apply to the use of data for statistical purposes, provided that the data provided have been anonymized.

5. Transfer of Data to Third Parties

In order to fulfil your mandate, we may have to pass your data on to third parties (e.g. the opposing party, substitutes, insurance companies, service providers which we use and to whom we make data available, etc.), courts or authorities. Your data will exclusively be forwarded on the basis of the GDPR, in particular if this is required in order to fulfil your mandate or with your prior consent.

Furthermore, we are informing you that, within the framework of our legal representation and support as your counsel, factual and case-related information about you will regularly be obtained from third parties.

Some of the recipients of your personal data mentioned above are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries which, according to the decision of the EU Commission, have an adequate level of data protection, or we take measures to ensure that all recipients have an adequate level of data protection, for which purpose we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).

6. Communication of Data Breaches

We seek to ensure that data breaches are detected at an early stage and, if necessary, reported to you without delay or the supervisory authority in charge whilst taking into account the data categories affected.

7. Storage of Data

We will not store data longer than is necessary to fulfil our contractual or legal obligations and to avert any liability claims.

8. Cookies

Our website uses so-called cookies to make it more user-friendly, effective and secure.

A cookie is a small text file that we transmit to the browser’s cookie file on your computer’s hard drive via our web server. This enables our website to recognize you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users visiting our Internet pages. The content of the cookies we use is limited to an identification number which does not allow for any personal reference to the user. The main purpose of a cookie is to recognize the visitors of the website.

This website uses two types of cookies:

  • Session cookies: These are temporary cookies stored in your browser’s cookie file until you leave our website, they are automatically deleted at the end of your visit.
  • Persistent cookies: For better user-friendliness, cookies remain stored on your terminal device and allow us to recognize your browser the next time you visit.

9. Google Analytics

Our website OG uses Google Analytics, a web analysis service by Google Inc. based in the USA (“Google”). Google Analytics uses cookies, which are text files stored on your computer, to help the website analyze the use of our site. In this context, we process your data on the basis of our overriding legitimate interest in producing easy-to-use website access statistics in a cost-efficient manner (Art 6 (1) (f) GDPR).

The cookie-generated information about your use of our website (including your IP address and the URLs of websites accessed) is transmitted to and stored by Google on servers in the United States. We do not store any of your data collected in connection with Google Analytics.

This website uses the IP anonymization option offered by Google Analytics. Google will therefore shorten/anonymize your IP address as soon as Google receives your IP address. On our behalf, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide us with other services relating to website and Internet use. Google will not merge the IP address transmitted by your browser in the context of Google Analytics with other data.

10. Server Log Files

In order to optimize this website in terms of system performance, user-friendliness and provision of useful information about our services, the provider of the website automatically collects and stores information in so-called server log files which your browser automatically transmits to us. This includes your Internet protocol address (IP address), browser and language setting, operating system, referrer URL, your Internet service provider and the respective date/time.

These data are not combined with personal data sources. We reserve the right to check such data subsequently if we become aware of specific indications of illicit use.
